  1. Do I have a good case?

This may seem obvious, but you need to make sure that you have a legitimate claim or “cause of action” in order to have a court support your position in regards to your case. Here’s an example:

the mere fact that you might have fallen in a store does not mean you will necessarily be successful if you decide to pursue a "slip and fall" claim. The elements of such a claim will need to be proven, including the store owner's fault in failing to ensure your safety.

  1. Have you made a final demand in connection with your dispute?

This step may seem obvious as well, but it is commonly overlooked by people as they attempt to rush to the courthouse with their problem. If they knew they were at fault and are able to make the situation right, most people would do what they could to resolve the matter. 

  1. Have you attempted to compromise or settle the dispute?

Take a look at the other party’s perspective on the issue. Maybe they do have a valid argument, or even a claim against you! If they do, adjust your own position. If a large amount of money is on the line, you may want to think about how much you are asking for. You may receive more money that way than you would after suing.

  1. Should you win, will you even be able to collect a judgement?

Take a long and hard look at the finances involved in the party that you’re suing. You need to be certain that you can college money from them before you spend yours to sue them.

  1. Do you have the money to pay a lawyer to handle the lawsuit?

Lawsuits are expensive. Period. Recovering your attorneys’ fees are often not an option. Ask your lawyer for an estimate of legal fees, and do the math. It may be more cost effective to settle. 

  1. Do you have the time and resources needed for a lawsuit?

In order to see a lawsuit through, you need three things: time, money, and energy. Keep in mind that you may find yourself with less time and energy to devote to work, family, and a social life during the lawsuit.

  1. Are you within the applicable “statute of limitations?”

Ask your lawyer to make sure that any time limits for filing a lawsuit have not run. 

  1. Where will you be able to sue?

If you are suing someone from a state outside of your own, a court in your stay may not have jurisdiction over that person. In this case, you will have to sue the defendant in his or her location. This will likely be more expensive and inconvenient for you.

  1. Is your claim small enough to bring in “small claims” or “conciliation” court?

Each state court system has a version of “small claims” or “conciliation” court, which is where they will only hear disputes in which a certain dollar amount is at issue. This is typically $5,000 or below.

  1. If you bring your claim in small claims or conciliation court, will you represent yourself?

Should your case meet the requirements for small claims court, you will most likely be able to represent yourself. You will save attorneys’ fees by doing so. However, you might want to pay an attorney to coach or advise you how to prepare your case.
